Avoid Conmen: List Of 12 Things to Do to Ensure a Property You’re Buying Is Genuine

Real estate is an industry that you will rarely miss to find conmen/women, brokers and imposters out to take advantage of the high demand – presenting documents that you might not realize are fake at once until it’s too late.

We have listed for you 12 things you need to do to confirm the authenticity of the documents in the property you’re about to buy be it land or a house;

Title deed verification

Always seek expert advice on the authenticity of a title deed someone has presented to you. Apart from doing an online search for the title deed, you can also visit the Land Registry that registered the title to enquire about.

Change of user

If the property you want to purchase has had a change of user, always ensure a new grant has been issued and the original one surrendered.

Alternatively, ensure the change of user has been issued on the original title/grant.

Leasehold property

For property under leasehold – be sure to check on the conditions endorsed on the title or lease as well as the terms of the lease.

Also, check on when the lease extension is due.

Consent

Before making final payment for land/property, always ensure the spouse of the seller (if married) has endorsed the sell – before the transfer of land is approved by the Lands Board, a spouse’s consent is mandatory.

Confirm Location

Always visit the property personally – don’t rely on WhatsApp photos. Get a mutation of the land from the Survey of Kenya which will give details of the location of the land and its size.

Title search

This can be done online on by visiting Lands Offices. For in person search, you will require a copy of ID, PIN, Copy of Title Deed, search application form and pay a fee (usually Sh1,000).

Sellers ID search

You will require a copy of the ID from the person selling you land/property and their photo to facilitate this search that is usually done at the Register of Persons. This search will help confirm whether you’re dealing with the legitimate owner of the property in question.

Company search

If the property in question is being sold by a company, you will need to do a company search – which is done at the Company registry.

The search will confirm if the company is registered or not, and if the persons listed are the directors or not.

CID check

Before finalizing a land deal, visit CID offices to check if the land in question appears among properties that have ownership rows.

Ask neighbours/local administrators

To confirm that the person selling land is the actual owner, it is good to ask neighbours, area village elder or chief. This will also help you know if the land has had a past or current dispute.

Check if the land has encroached road/railway reserves

Contact authorities like Kenya Rural Roads Authority, Kenya National Highways Authority or Kenya Railways to confirm is the land has encroached areas reserved for road/highway expansion or railway line.

Looking at the history of the land will also help you know if it sits on a road/railway reserve.

Gazetted land use

Confirm under which category the land has been gazetted for use – Agricultural, industrial, residential or public land.

If all the above-listed things are in order, then you can be sure that the deal you’re about to seal is genuine.
