Land leasing is a process in which a legitimate landowner agrees to allow another person to use his/her land for a given period of time in exchange for land.

Normally, a person, or an entity leasing land does so for a commercial reason – seeking to use the land in an activity that will generate profit for him/her.

A lease can go for up to 99 years for public land or up to a year for agricultural land – the most common among locals in Uasin Gishu.

So who can lease land?

If you own land and have proper documentation for it, you can lease land. The government is also allowed to lease public land while local authorities can also lease trust land. The maximum term of government leases is 99 years.

What are the types of land leasing available in Uasin Gishu?

Being an agricultural county, the most common type of land leasing is for agricultural purposes. In this type of land leasing, a landowner gives away his/her land to a person intended to use the land for agricultural purposes.

Note that leasing does not transfer ownership of the land, it only grants permission to somebody else to use the land for a given period.

The lease is usually for a period of one year where the person leasing land will be allowed to plant whatever type of crop he/she wants and upon expiry of the agreed period of time, the owner is allowed access to the land.

Land leasing for agricultural purposes is most common in rural areas and a fee ranges from as low as Sh10,000 per acre to Sh50,000 annually.

For the land located near an urban area of a prime place like a road, such land can also, be leased for business purposes.

Leasing land for business might be for a longer period than that for agricultural purposes. However, business leases usually need only a portion of land like a half an acre or less.

Under this category, land can be leased for among others roadside eateries (food vibandas and mama mboga stalls), fuel stations, garages, carwash businesses, churches, and roadside car dealers.
