Construction Approval Process in Kenya

 

Are you planning to construct a commercial building within Eldoret town, Uasin Gishu, or any other part of the country?

If your answer is yes, read on. This article will help you avoid getting on the wrong side with construction law enforcers. I’m sure you have come across many construction sites marked X by NCA – and this is not something you would love to see at your site.

In Kenya, there are three main approval stages that a building has to go through. These stages, according to Eng. Monda Makori, a civil/structural engineer, contractor, and architect, involves:

a)    County Government Approvals

b)    National Environmental Management Authority (NEMA) approvals

c)    National Construction Authority (NCA) project registration.

COUNTY GOVERNMENT APPROVALS

In this stage, you will need architectural drawings for the building worked on by a registered Architect/Firm by the Board of Registration of Architects and Quantity Surveyors (BORAQS) and structural drawings worked on by a registered Structural Engineer/Firm registered by ERB.

Other requirements that will enable you to get the approval at this stage are;

-      Land ownership document (Tittle deed/Share Certificate/ lease document)

-      Land rates Clearance Certificate

-      Land search document (Not more than three months old)

-      Mutation/Survey map

-      Approval fee (Determined by your design)

Most counties have enacted the e-Development permit System, an online platform through which architects are able to submit their drawings to the County.

The architectural plans are submitted first and once approved, is when the structural plans can be submitted by the structural engineer.

Documents that would be required when submitting a new application include:

i)             Architectural Drawings from an architect/firm registered by BORAQs.

ii)            Structural drawings from a structural engineer/firm registered by ERB (Engineers Regulatory Board)

iii)           Copy of Land ownership document Land rates clearance certificate

iv)           Land search document (not more than three months old)

v)            Survey map from Survey of Kenya Submission fee payment (This is determined by your design)

Once the application is successful, the architect will receive an approval notification.

The architect is still required to submit hard copies of the plans to be stamped by the County, even after submitting the documents online.

The engineer must also do the same after the architect’s plans have been stamped. With approved drawings, construction may start while the application for a building permits.

NEMA APPROVALS

For Commercial projects, NEMA Project registration is required. You will need to obtain a project report from a Licensed and registered environmental expert.


The report should be submitted together with County Approved drawings for NEMA approval and Registration.

PROJECT REGISTRATION BY NATIONAL CONSTRUCTION AUTHORITY (NCA)

To successfully get your construction registered and approved by NEMA you will need to have;

-      Contractor registered by NCA

-      Registered Architect/Firm

-      Registered Engineer/Firm

-      Approved Architectural and Structural drawings.

-      NEMA certificate.

-      Client’s Kenya Revenue Authority (KRA) certificate.

-      Bill of Quantity (B.o.Q) Summary

-      Client and Contractor signed contract documents.

-      Site signboard Showing all approvals and professionals engaged in the project

-      N.C.A registered Contractor Safety sign

-      Personal Protective Equipment [P.P.E]

-      Sufficient hoarding and fencing

-      N.C.A Compliance Certificate

-      N.C.A-accredited skilled workers and site supervisors.
