  1. Land Identification
Land on sale adverts is a guidance to identify a new land. It gives you the location and the size of land. Identification can also be done through referral of someone who is aware of land being sold.
     2.  Search at the Lands Registry
After identifying a piece of land that meets the desired standard, you should get a copy of seller’s title deed which is a requirement for land search. Fill a search application form at the Regional Lands Offices at the Ministry of Lands in Eldoret town and attach a copy of the title deed. The process of land search takes about three days. Search results show details of the land including the registered owner of the land, the size of the land as well as any caveats registered against the title deed.
  1. Land Rates
 A certificate of clearance is issued at a fee at the Eldoret Municipal Council. This helps you to unearth any unpaid land rates which should be factored in the buying price. 
  1. Obtain (two) Land Maps
You can acquire the land maps from either the department of lands in Eldoret or a local surveyor at a cost of Ksh.300 each. One map is normally drawn to scale and the other is an overview of the land showing adjacent plots.
  1. Ground Verification
After obtaining the maps, you should make visits to the land together with the seller and the surveyor to verify the dimensions. Ensure that you erect beacons on the land to avoid future disputes.
  1. Agreement
The law requires any land transaction to be in writing. You therefore should appoint a lawyer who is a professional in drafting property sales agreement. Sale agreement should indicate terms of sale including the names of buyer and seller, the price of the land, mode of payment and documents to be supplied by the seller to facilitate registration of transfer of the land to the buyer.
  1. Post Agreement Transaction
You may be required to pay in cash or in installment according to the agreement. Before making any initial payments, you should ensure the title deed and other legal documents are in the custody of lawyers.

  1. Land control board clearance
The Land Control Board (LCB) is a forum that comprises area elders and Uasin Gishu County commissioners and its duty is to ensure that land transactions are conducted in a transparent manner. They give the final consent for the land to be sold. LCB costs Ksh.1000.
However, instead of waiting for the LCB meeting, there is a special Land Control Board (SLCB), which involves the Assistant County Commissioner and the two transacting parties at a cost of Ksh.5000.
  1. Land Transfer   
Once the payment is made, and the seller inks the land transfer forms, you should proceed to the Ministry of Land armed with the consent from LCB, land search, clearance from county council, 3 passport photos, KRA pin certificate, sale agreement and old title deed to change ownership of the land. It takes two weeks and Ksh.5000 to process a new title deed.
  1. Stamp Duty and Transfer Fees 
You should conduct a valuation of the land using a valuation form filled by the seller. The Lands office will use these documents to compute the stamp duty payable. This stamp duty is 4% of the land for urban areas.
  1. Post Purchase Activity
Congratulations! You are a new plot owner! However, you should do another search with the Ministry of Land to confirm if the land reads your details.
